Official Rules & Prize Pack

OFFICIAL RULES & REGULATIONS
Gerwer’s Contest Promotion valid from Feburary 20th, 2009 to May 1st, 2009, and subject to limited supplies.

1. Eligibility. The Gerwer’s Contest promotion is open to legal residents of the United States and Canada, as long as it abides by federal, state / provincial, and/or local law. Limit one entry per person.

2. By entering the contest, all entrants agree to the official rules & regulations listed here. All entries will become the property of Four Star Distribution. Void where prohibited by law.

3. How to play. Send in your “Sketchy Scrap Book” for Frank to judge: Submit a scrapbook including collections of original drawings, artwork, clippings, photos, Polaroids, words, collages, paintings, etc. BE CREATIVE!
Please include your full name, mailing address, phone number, shoe size (please verify your size first), tee-shirt size and e-mail address with entry of your original scrapbook. Send all this information and the scrapbook to:

4. Prize Breakdown. No prizes can be exchanged for cash, unless Four Star Distribution elects, at its discretion, to award the corresponding cash value in lieu of the actual prize. Unclaimed prizes will not be awarded.

5. The prize breakdown is as follows: 
Grand Prize (one winner): One limited pair of C1RCA Combat M.I.A. shoes made using a piece of Frank’s flannel in the size of winner’s choice (US size 6-13). One year supply of C1RCA Combat shoes totaling twelve pairs (one per month). One C1RCA Combat tee shirt picked by Four Star Distribution. And “Frank’s Setup” including one skateboard deck from Anti-Hero, one set of Thunder trucks, and one set of Spitfire wheels, courtesy of DLX SF.

6. Runners-Up (up to 4 winners): One limited pair of C1RCA Combat M.I.A. shoes made using a piece of Frank’s flannel in the size of winner’s choice (US size 6-13). One C1RCA Combat tee shirt picked by Four Star Distribution.

7. General. By participating in this promotion and accepting the prize, winner(s) release Four Star Distribution and its affiliates, subsidiaries, advertising, promotional and production agencies from any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred and including, without limitation, lost mail, a lost or damaged scrap book, property damage, personal injury and/or death which may occur in connection with acceptance and/or use of the prize. By participating in this promotion, winners also grant Four Star Distribution permission to use winners’ name, photo, and scrapbook for promotional purposes. The contest rules shall be interpreted according to the substantive laws of the State of California, without regard to its choice of law principles. Jurisdiction for any litigation arising from these contest rules and/or the contest itself shall lie exclusively with the appropriate courts in the County of Orange, California. No more than the advertised number of prizes will be awarded.

8. Copyright:All Entries submitted to the Contest must be original. You must be the sole owner of any copyright of any content submitted. Your submission of each Entry is your guarantee that you are the author, creator or sole copyright holder of the scrapbook and contents submitted. By submitting an Entry, you also represent and warrant that the Entries that you submit do not infringe on the copyright of any other persons or entity and that you have not submitted the scrapbook and/or contents to any other contest. If the ownership of any Entry is contested in any manner, Four Star Distribution may disqualify that Entry.

9. Rights of Use You shall retain the copyright to any Entry and all other rights thereto EXCEPT: by entering the Contest, you agree to have your submitted scrapbook displayed on C1RCACombat.com and/or C1RCA.com websites and in any media, including our MySpace and Facebook pages, as decided by Four Star Distribution without any fee or without any other form of compensation. In addition, you hereby grant an unlimited license to Four Star Distribution to copy, display, broadcast, distribute or otherwise use your Entry for any purpose, including, but not limited to, promotion of Four Star Distribution and it’s brands’ products. You agree that Four Star Distribution shall have the exclusive right to edit, adapt and publish your Entry and may use it in any media in association with the Contest without attribution or compensation to the Entrant, his or her successors or assignees or any other entity. You agree that Four Star Distribution will not be liable to you or to any third party for any editing, adaptation, modification and/or publication of any Entry. Publicity and Advertising Except where prohibited, participation in the Contest constitutes irrevocable consent to Four Star Distribution and their agents to use, record reproduce, publish, display, perform, translate, and distribute, the names, likeness, voices, quotations, opinions and biographical information of Entrant, including without limitation, any photograph or recording for promotional purposes in any media, worldwide, without further payment or consideration; and the name, likeness, voice and biographical information of any natural person appearing in the Entry, including without limitation any photograph or recording, for any promotional purpose in any media, worldwide, and/or for any other commercial or non-commercial corporate purpose, including without limitation use on merchandise or for marketing, without attribution or further payment or compensation to the Entrant, his or her successors or assigns or any other entity.

This contest is subject to these Official Rules and any other rules at any time promulgated by Four Star Distribution. Four Star Distribution reserves the right to amend these rules at any time in its sole discretion. In the event that any provision or rule is found unenforceable by any court of appropriate jurisdiction, such provision or rule shall be severed here from and the remainder of the Official Rules shall remain valid and enforceable.
